Terms and Conditions 

Blütengold GmbH

These General Terms and Conditions (hereinafter TCs) apply to all orders and contracts concluded via the online shop of Blütengold GmbH, Altelsweg 9, 3661 Uetendorf, Switzerland (hereinafter Blütengold).

Blütengold sells its products to customers residing in Switzerland as well as in member states of the European Union.

1. Scope

These T apply to all orders for goods placed via the Blütengold online shop. Deviating conditions of the customer do not apply unless Blütengold expressly agrees to their validity in writing.

2. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.
The contract is concluded as soon as Blütengold accepts the customer’s order by sending an order confirmation via email.
Blütengold reserves the right to refuse orders without giving reasons, particularly in cases of suspected misuse or false information.

3. Prices

All prices are in Swiss Francs (CHF) or Euros (EUR), depending on the selected delivery country.
Prices include—where applicable—statutory VAT.

Shipping costs are shown separately during the ordering process.

Blütengold reserves the right to change prices at any time. The price displayed at the time of the order is decisive.

4. Payment Terms

The available payment methods are displayed in the online shop.

For orders from Switzerland, payment processing is handled via zahls.ch. For orders from the European Union, payment processing is handled via VivaWallet.

The charge is made immediately upon ordering, unless otherwise agreed.

5. Delivery

Delivery is made to the delivery address specified by the customer.

Delivery times are non-binding unless expressly agreed otherwise.

Blütengold is entitled to make partial deliveries, provided this is reasonable for the customer.

6. Transfer of Risk

For deliveries within Switzerland, the risk passes to the customer upon handover of the goods.

For deliveries to the European Union, the risk passes to the customer upon handover of the goods to the transport company, to the extent permitted by law.

7. Right of Withdrawal (EU customers only)

Customers residing in the European Union have the right to withdraw from the contract within 14 days without giving reasons.

The withdrawal period is 14 days from the day on which the customer received the goods.

To exercise the right of withdrawal, the customer must inform Blütengold of the decision by means of a clear statement (e.g., by email).

Excluded from the right of withdrawal are:

  • sealed goods that are not suitable for return for reasons of health protection or hygiene, if the seal was removed after delivery.

8. Warranty

Statutory warranty provisions apply.

Obvious defects must be reported to Blütengold immediately after receipt of the goods.

9. Liability

Blütengold is only liable for damages resulting from intentional or grossly negligent breaches of duty, to the extent permitted by law.

Liability for indirect or consequential damages is excluded.

10. Disclaimer for Effects of CBD Products

The CBD products offered by Blütengold are not medicinal products and do not replace medical or therapeutic treatment.

No healing or efficacy promises are made. Use is at your own responsibility.

11. Data Protection

The processing of personal data is carried out in accordance with Blütengold’s privacy policy, which is an integral part of these T

12. Applicable Law and Jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction is—to the extent permitted by law—the registered office of Blütengold GmbH.

13. Final Provisions

Should individual provisions of these T be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Blütengold reserves the right to change these T at any time. The version current at the time of the order applies.
